By providing Your Business Service Provider Dalight Connections Care with your e-mail address, you agree that we may use your e-mail address to send you important notifications and communications about our services, news and special content. If you do not wish to receive these e-mails, you may opt-out of receiving them by sending us your request through our contact information or by using the "unsubscribe" option in the e-mails themselves. This option may prevent you from receiving emails about our services, important news and special content.
3. DESCRIPTION OF SERVICES
Your Business Service Provider; Dalight Connections Care (a trading name of Dalight Connections Ltd) offers a wide range of personal and B2B services including Welfare Calls, well-being calls, Welfare Calls to Lone Workers, Facilitating Well-being Meetings, Phone-a-friend services, Companionship Care, Events, Trips, Tours and Holidays, Carer-Supported Holidays, Respite and Overnight Home Care serving the general public, businesses as well as vulnerable adults especially the elderly and people living with minor to moderate disabilities. Our services are designed to suit the specific needs of each client, ranging from the ongoing supply of services to the provision of specialised services.
Clients interested in contracting our services can request a detailed quotation based on their specific requirements. Each quotation is customised and will reflect the nature and scope of the services requested. The provision of our services may be subject to formal acceptance of the proposed quotation, which will include the signing of a service contract setting out the terms and obligations of both parties.
It is important to note that Your Business Service Provider Dalight Connections Care works collaboratively with each client to ensure that the solutions offered meet their expectations and business needs. Our commitment is to deliver the highest quality products and services, ensuring that our clients' processes and operations are kept running smoothly.
4. LIMITATION OF LIABILITY

In the event of a discrepancy in the supply of products or the provision of services, our liability shall be limited, at our discretion, to the replacement of the defective product or the re-performance of the affected service, provided that the customer has complied with all contractual obligations. We do not warrant that our products or services will be free from errors or interruptions, nor do we warrant that they will meet the customer's specific standards or particular expectations, unless expressly agreed in the service contract.
Your Business Service Provider Dalight Connections Care shall not be liable for inaccuracy or errors in information provided by third parties or for any results or decisions made by the customer based on such information or the use of our products or services. It is the client's responsibility to verify that the products and services purchased comply with the legal and regulatory requirements applicable to their business activities.
By agreeing to use our services or purchase our products, the customer acknowledges and agrees that the customer assumes the risk associated with their use and that Your Business Service Provider Dalight Connections Care makes no express or implied warranties beyond what is expressly stated in the service contract or accepted quotation.
5. COPYRIGHT
All content on Your Business Service Provider website Dalight Connections Care, including, without limitation, names, logos, trademarks, images, text, columns, graphics, videos, photographs, illustrations, software and other items are protected by copyrights, trademarks and/or other intellectual property rights owned and controlled by Your Business Service Provider Dalight Connections Care or by third parties who have licensed or provided their material to the website. You agree to defend and indemnify Your Business Service Provider Dalight Connections Care from and against any claims, causes of action, demands, recoveries, losses, damages, fines, penalties or other costs or expenses of any kind or nature including but not limited to reasonable legal and accounting fees, brought by third parties as a result of:

12. CHANGES AND TERMINATION

This agreement together with the privacy policy and any other legal notices published by Your Business Service Provider Dalight Connections Care, shall constitute the entire agreement between you and Your Business Service Provider Dalight Connections Care concerning and governs your use of the website and services.

14. DALIGHT CONNECTIONS CARE
By engaging Dalight Connections Care (a trading name for Dalight Connections Ltd) you agree that Dalight Connections Care (a trading name for Dalight Connections Ltd) is an introductory agency and event organiser.

- The Supplier (Dalight Connections Care a trading name for Dalight Connections Ltd) shall perform any agreed Services in a professional and competent manner, in line with applicable industry standards and good practice, provided always that:

(a) In respect of introduction or referral-based services, the Supplier (Dalight Connections Care a trading name for Dalight Connections Ltd) shall not be responsible for the acts or omissions of any third party introduced; and
(b) The Customer accepts that the Supplier (Dalight Connections Care a trading name for Dalight Connections Ltd) does not guarantee outcomes, and that responsibility for decisions or arrangements made following an introduction rests solely with the recipient of the introduction.
Supplier’s Obligations
- The Supplier shall:
(a) Provide the Services with reasonable skill, care, and diligence, in accordance with applicable laws and industry standards;
(b) Ensure that all personnel providing the Services are appropriately trained, qualified, and bound by confidentiality obligations;
(c) Provide the Customer with regular updates regarding service performance, as agreed;
(d) Inform the Customer without undue delay of any issues that may affect service delivery.
- The Supplier may update or modify the Services where necessary to comply with legal requirements or to improve service efficiency, provided that the modifications do not materially reduce the scope or quality of the Services.

Customer’s Obligations
The Customer shall:
(a) Provide the Supplier with all necessary and accurate information required for the provision of the Services in a timely manner;
(b) Obtain all necessary consents from individuals (e.g., employees) before providing their Personal Data to the Supplier (Dalight Connections Care a trading name for Dalight Connections Ltd), where such consent is required under UK GDPR and other applicable Data Protection Laws;
(c) Ensure that employees or other individuals receiving the Services have been informed that: ï‚· ï‚· ï‚· Their Personal Data will be processed by the Supplier (Dalight Connections Care a trading name for Dalight Connections Ltd) solely for the purpose of delivering the Services; They may be contacted directly by the Supplier (Dalight Connections Care a trading name for Dalight Connections Ltd) as part of the service provision; Their data will be handled, stored, and retained - See (Confidentiality & Data Protection);
(d) Promptly notify the Supplier (Dalight Connections Care a trading name for Dalight Connections Ltd) of any changes or updates to the Personal Data provided, including withdrawal of consent (if applicable);
(e) Ensure that its use of the Services and provision of Personal Data complies with all applicable laws, regulations, and internal policies.
- The Supplier shall not be liable for any claims, penalties, or regulatory action arising from the Customer’s failure to comply with its obligations, including any failure to obtain valid consent where required.

15. EVENTS / ACTIVITIES
As a participant in events and activities organised by us, you agree to the following:

You or your immediate caregiver must answer the pre-event questionnaire truthfully and to the best of your abilities

Keep all contact information with us accurate and up-to-date

We may request a review of our service with you every six months. You may request a review if you would like to make a change to the service received

Dalight Connection Care (a trading name for Dalight Connections Ltd) take our duty of care seriously and we are highly invested in your safety and wellbeing. We will do our very best to ensure your safety, mitigate risks and prioritise your well-being before and during activities, visits and events, however, Dalight Connections Care is an event organiser and introductory agency, therefore, your safety and well-being are ultimately your responsibility and that of the primary self-employed carer/support worker/companion who is supporting you or your own carer/support worker/companion attending our event/activity with you.

Our events include opportunities for you to consume alcohol. You’re strongly advised to drink responsibly. We do not accept liability or responsibility for any repercussion as a result of excessive drinking

You must be an adult aged 18 or over. We only accept official photo identification such as a passport, driver’s license and national identity cards.

You must purchase your ticket before you participate in any event. Tickets purchased from third-party distributors and promoters will be redeemed at the start of the event.

Tickets and payments are non-refundable though in some cases could be used as credit at alternate dates at our discretion
-
We reserve the right to cancel an event at our discretion and for any reason. We will endeavour to communicate this as quickly as possible and make refunds or replace tickets where possible.

We reserve the right to change or modify our events without notice. We will endeavour to make comparable substitutes but accept no liability

Challenging Behaviour: Participants with challenging behaviour or a history of challenging behaviour are mandated to attend our event with their own support worker (1:1). Dalight Connections is happy to match said participant with a trained and vetted health and social care professional should you require one to attend our event

Dalight Connections does not accept responsibility for participants’ behaviour and we reserve the right to refuse entry or remove participants who exhibit challenging behaviour, are drunk, aggressive, anti-social, disorderly or abusive. We will not be refunding tickets or covering any additional cost incurred by the participant as a result

The participants will agree to indemnify us and all our associates and representatives against any third-party claims as a result of the participant's behaviour and actions. Any damages or loss caused by the participant is solely the participant's responsibility.

All venues on our event roster reserve the right to refuse entry and remove participants for challenging behaviour as aforementioned and we do not accept liability and will not be refunding ticket or payment

At all our events, trained, polite and non-intrusive photographers and videographers operate. We own the copyright to all pictures or videos taken. If you don't want to be in any pictures or videos please let us know by email or have a word with us at the start of the event

All our prices are reviewed from time to time and at least once per calendar year. Changes in pricing and modes of payment are at our sole discretion. We will notify you via email at least a month in advance.

For active members of the Activity Club, funders and customers will be notified should funding be withdrawn

16. WELFARE CALLS
By subscribing to our Welfare Calls Service with Dalight Connections Care, you agree to the following:

Dalight Connections Ltd is not an emergency or medical service

Dalight Connections Ltd is not a substitute for professional or medical help with mental health and well-being.

We will be contacting the referred person to confirm they want to receive calls from our Welfare Calls service. We will schedule suitable times and get their consent to keep their personal information. Please be advised that once we have reached the customer the content of their calls is confidential and we will not be sharing their information with you without their consent

Provide two contacts of persons who have agreed to be contacted and be responsible for arranging an in-person visit with the customer when we are unable to reach the customer on the telephone.

We will call the customer on the agreed days and at the agreed time. On the occasion when changes are necessary, we will provide the customer with as much notice as possible
-
To build relationships we will make sure regular staff work with each customer
-
You will answer every scheduled call with the grace of two follow-up calls (15 minutes apart)
-
You will inform us if you will be outside the United Kingdon on your scheduled call days
-
Keep all contact information with us accurate and up-to-date
-
The named persons will be contacted and they will arrange an in-person visit should the customer miss their scheduled call and the two follow-up calls (15 minutes apart) or their response during their call give us concern. Should we be unable to reach your contact persons or they are unable to make contact with you in person (all within four hours of the initial call), we will escalate to the police. The police will be the ultimate escalation and we will have no more liability beyond that notification

If you do not have a contact person, you must speak to us on your scheduled call days. We will escalate to the police immediately should you miss your scheduled call and the two follow-up calls (15 minutes apart). The police will be the ultimate escalation and we will have no more liability beyond that notification

Either party can end the Welfare Call service subscriptions at any time via email. Email us at info@dalightconnectionscare.co.uk to cancel your subscription. You will need to provide a minimum of 20 calendar days’ notice before your next Direct Debit date to prevent further Direct Debit payment collection.

We review our Welfare Call service with the customer every six months. You may request a review if you would like to make a change to the service received

The funder or customer should email us at info@dalightconnectionscare.co.uk if you have any problems or complaints. We also welcome compliments, please email us those too.

17. FORCE MAJEURE
Your Business Service Provider Dalight Connections Care shall not be liable for any failure or non-performance of services due to causes beyond its reasonable control, including but not limited to acts of civil authorities, acts of military authorities, riots, acts of nature and natural disasters, and other acts which may be due to unforeseen circumstances and which may prevent the performance of our services.
18. ARBITRATION
You acknowledge and agree that any dispute, claim or controversy arising out of or relating to these terms and conditions, whether for breach, termination, performance, interpretation or validity, as well as any aspect of your use of the website and our services, shall preferably be resolved by binding arbitration between you and Your Business Service Provider Dalight Connections Care. Notwithstanding the foregoing, the right of both parties to bring individual claims in a court of competent jurisdiction if they deem it necessary remains.
In the event of any dispute arising in connection with your use of the website and our services or breach of these terms and conditions, both parties agree to seek resolution through an arbitration process. This process will be conducted before a recognised and respected arbitration entity, selected by mutual agreement of both parties and following the applicable commercial arbitration rules.
In addition, the user agrees, to the extent permitted by applicable law, not to initiate, join or participate in class action lawsuits associated with any claim, dispute or controversy that may arise in connection with the use of the website and our services. This commitment seeks to promote a more agile and personalised resolution of any conflict, favouring arbitration and individual legal actions over class actions.
19. APPLICABLE LAW AND JURISDICTION
These terms and conditions shall be governed by and construed in accordance with the laws of the United Kingdom. Any dispute relating to these terms and conditions shall be subject to the exclusive jurisdiction of the courts of the United Kingdom.
